This page states plainly what My Trademark Vault is, and is not, so there is no ambiguity before you use the Service. It restates and expands on Section 1 of our Terms of Service.
My Trademark Vault is an independent trademark filing-assistance and brand-screening service. We are not a law firm, we do not provide legal advice, and using the Service does not create an attorney-client relationship between you and My Trademark Vault. We are not affiliated with, endorsed by, or an official agency of the United States Patent and Trademark Office (USPTO).
Where a matter requires legal judgment — most notably, responding to a contested USPTO Office Action — a licensed U.S. trademark attorney reviews the work before it is released. Where the USPTO requires an applicant to be represented — most notably applicants domiciled outside the United States — that attorney is appointed as attorney of record on the filing. That attorney's relationship is with the filing itself as required by USPTO rules; it does not make My Trademark Vault, as a company, your law firm.
We do not guarantee that any trademark application will be approved, registered, granted a particular scope of protection, or free from opposition. We do not guarantee any particular result from an Office Action response. Decisions about a trademark application are made by the USPTO, not by us. A Free Brand Audit result — high or low — reflects what our screening found in the public sources it checked at the time it checked them; it is not a legal clearance opinion and not a guarantee of registrability or refusal.
If your situation is complex, high-stakes, or you are simply unsure, we recommend consulting a licensed trademark attorney directly before relying on anything from this Service — including our own attorney- reviewed filings and Office Action responses, which reflect the reviewing attorney's professional judgment on that specific filing, not a blanket legal opinion about your broader business or brand strategy.
Any class suggestion or cost estimate produced by our cost estimator, or given to you in conversation, is based solely on the information you provide at the time you request it. It is an estimate, not a quote, and not a legal determination of the correct classes for your mark. Trademark classification depends on how goods and services are actually offered and sold, and reasonable people — including USPTO examining attorneys — can reach different conclusions on the same facts.
If any of the information you gave us changes before filing — what you sell, how you sell it, who you sell it to, or the wording used to describe it — the classes and the total may change with it. Estimates also exclude USPTO surcharges that depend on how an application is written, and any later-stage fees such as extensions, statements of use or Office Action responses. USPTO fees are set by the government, are payable to the USPTO, and are non-refundable once processed, whatever the outcome.
You remain solely responsible for reviewing, verifying and confirming the classes, the goods and services wording, and the total payable before any application is submitted, and for verifying current fees directly with the USPTO. Nothing produced by the estimator is a substitute for the review a licensed trademark attorney carries out on your specific filing.
