The registration was cancelled because the Section 8 declaration was not filed or accepted
Official wording: CANCELLED - SECTION 8
Your registration is no longer in force. It was cancelled because the required declaration of continued use was not filed in time, or was filed and not accepted. This is the most common way a valid trademark registration is lost, and it is almost always administrative rather than substantive.
What happened, in sequence
A Section 8 declaration was due on or after the fifth anniversary of registration and no later than the sixth, with a six-month grace period afterwards carrying a surcharge. Both windows passed without an accepted filing, so the registration was cancelled. Nobody decided your mark was unregistrable - the office stopped hearing from you.
Cancelled is not suspended, and there is no renewal to catch up on
A cancelled registration cannot be revived by filing the declaration late once the grace period has gone. The route back is a new application, which means a new filing date, a new examination, and no credit for the years the registration was on the register.
You have probably not lost the brand
Registration and ownership are different things. If you have kept using the mark in commerce you likely still hold common-law rights in the areas where you actually trade, and those rights are the basis for refiling. What you have lost is the nationwide presumption of validity and ownership, the ability to use the ® symbol, and the standing that platforms like Amazon Brand Registry ask to see.
Refile sooner rather than later
The risk of waiting is that the register is now clear of your mark. Anyone who files something similar in the meantime gets ahead of you, and a new application of theirs can become the basis for refusing yours. If this brand matters, the refiling is time-sensitive even though no formal deadline is running.
Check the file before assuming the worst
Open the registration in TSDR and read the correspondence. A declaration that was filed but found deficient reads differently from one never filed, and if a deficiency notice was issued and missed, the circumstances are worth a licensed attorney's eye before you give up on the registration.
Confirm this against your own record
Status code descriptions are administered inside USPTO systems and published wording varies slightly between sources. Your file is the authority. Enter your serial number in TSDR to see your current status, every document filed, and any live deadline.
Open TSDRLooking this up for a client rather than for your own mark? We keep a network of licensed attorneys who review the cases that come through us. It is case-by-case paid work and a free listing — never a referral fee or a cut of anything.
