USPTO STATUS 713

The registration has been cancelled

Official wording: Cancelled — Section 18

A cancellation status means the registration is no longer in force. Published descriptions of this particular code differ between sources, so treat the wording here as orientation and read your own record in TSDR for what actually happened to your file.

A deadline may be running. Confirm the date on your own record before you do anything else.

What cancellation means

The mark is off the register. You may still hold common law rights from continued use in the areas where you actually trade, but you lose the nationwide presumptions that registration gave you, along with the right to use the R symbol.

How registrations end up cancelled

Most commonly a missed maintenance filing — the Section 8 declaration due between the fifth and sixth year, or the Section 9 renewal. Cancellation can also follow a proceeding brought by another party at the Trademark Trial and Appeal Board, which is a different and more serious situation.

What to do now

Open TSDR and read the documents in your file, not just the status line. The correspondence will say whether this followed a missed deadline or a proceeding. Those two paths have completely different options, and the second usually needs a licensed attorney rather than a filing service.

Confirm this against your own record

Status code descriptions are administered inside USPTO systems and published wording varies slightly between sources. Your file is the authority. Enter your serial number in TSDR to see your current status, every document filed, and any live deadline.
